The ground rules for using Business Ascension and our website services.
These terms govern your use of this website and the website, hosting, and related services provided by Business Ascension (“we”, “us”). By signing up for a plan or using our services, you agree to these terms. If you do not agree, please do not use our services.
We design, build, host, and maintain websites and related online tools for small and local businesses. The features included depend on the plan you choose: Business Essentials, Business Pro, or Business Gold. The current plans and what each includes are listed on our pricing page.
Services we describe as available separately, such as advertising management or larger print and vehicle design work, are quoted on their own and are not part of a monthly plan.
There is no long-term contract. You can cancel at any time by contacting us, and cancellation takes effect at the end of your current billing period. After that, no further charges are made.
If you cancel, your website is taken offline, as described below.
We aim to deliver your first site link within 48 hours. The 48 hours starts once we have received your completed intake form and the materials we need to build. Delays in sending us your information, domain access, or review feedback extend the timeline.
You agree to give us accurate information and the rights needed to use the content you send, including photos, logos, text, and trademarks. You are responsible for the claims your website makes about your business, including licenses, certifications, pricing, and service areas, and for following the laws that apply to your business.
Your website is built and hosted on our platform as part of your monthly plan. If your subscription ends, the website is taken offline. If you would rather own the website files and host them yourself, we offer that as a separate one-time build, quoted on request.
Unlimited content edits are included for as long as you subscribe. Edits means changes to the text, images, and details of your existing site. Building new pages or features beyond the scope of your plan may be quoted separately.
You agree not to use our services to:
We may suspend or remove a website that violates these terms.
Our services rely on third-party platforms, such as hosting, payment, chat, scheduling, and messaging providers. We are not responsible for outages or changes made by those providers, though we will work to minimize any impact on you.
You keep ownership of the content you provide. We keep ownership of our templates, code, designs, and tools. While you are subscribed, you have the right to use the website we build for you for your business. Any logo or brand assets created specifically for you are delivered to you as described when you sign up.
Our services are provided “as is” and “as available.” We do not promise any particular search ranking, number of leads, or business result, because those depend on many factors outside our control. We do not promise that the services will be uninterrupted or error free.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to our services is limited to the amount you paid us in the three months before the claim arose.
Some places do not allow certain limits, so parts of this section may not apply to you.
You agree to defend and hold us harmless from claims arising from the content you provide, your use of our services in violation of these terms, or your business operations.
We may update these terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If a change is significant, we will notify active customers. Continued use after a change means you accept the updated terms.
These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be handled in the courts located in that state.
